CORPORATE LAW
The Giannini Law Firm provides legal counsel and assistance—in legal proceedings as well as extra-judicial matters—to both ITALIAN AND FOREIGN BUSINESSES in CORPORATE LAW, BANKING LAW, BANKRUPTCY, and INTERNATIONAL LAW.
Our clients have access to our international corporate services from the inception of a business to its winding up, including preparation of bylaws, and the myriad of various corporate matters that arise during the life of a business: mergers/acquisitions, shareholder issues and liquidation procedures, to name a few.
Since 2003, Attorney Patrizia Giannini has been listed on the Curatore Fallimentare, Rome’s official register of court-appointed trustees/receivers to businesses in receivership.
FAMILY AND CHILD PRACTICE
Our attorneys have substantial experience in resolving disputes arising out of family crisis. We are particularly sensitive to and sympathetic with the delicate and powerful emotional component attendant to matters of
separation and/or
divorce. We have practiced extensively in juvenile court as well, dealing with family crisis and legal issues involving
minors. Further, attorney Patrizia Giannini has extensive experience in
adoption law (national and international), as well as
child custody issues. Our lawyers have consistently been appointed guardian ad litem in various circumstances.
INHERITANCE LAW (wills and trusts)
Our attorneys have equally substantial experience in the field of inheritance law, including wills, estates, trusts, and other matters involving testamentary succession.
REAL ESTATE
Since our inception, our lawyers have practiced extensively in real estate law. We represent buyers and sellers in complex real estate transactions of both land and/or property, commercial and residential, from drafting contracts, purchase agreements and lease/rental agreements, through closing. Our attorneys are equally adept at negotiating these matters in or out of court or other formal proceedings, including eviction issues, adverse possession, foreclosures and estate sales. We also assist clients in condominium by-law issues.
INSURANCE LAW
Since 1997, attorney Patrizia Giannini has been an attorney of record to several of the major Italian insurance groups, both as counsel and consultant in first party and third party claims for coverage and/or compensation arising out of claims to person or property. Attorney Giannini has extensive experience in all types of insurance issues, including commercial and financial risk issues, as well as claims for accident, injury, and illness.
ITALIAN CITIZENSHIP
The Giannini Law Firm—comprised of attorneys who speak Italian, English, and Spanish—specializes, among other areas, in:
- Assistance with claims for and/or recognition of Italian citizenship for descendants of Italian citizens;
- Searching for birth and marriage certificates of Italian ancestors, in every city in Italy;
- Assistance in obtaining an Italian passport;
- Assistance in acquiring Italian citizenship;
- On-line support.
In the case of descendants of an Italian mother born before 1948, the Giannini Law Firm pursues actions for judicial recognition of citizenship in accordance with
Judgment No. 4466 of 25.02.2009 of the Italian Supreme Court.
ALTERNATIVE DISPUTE RESOLUTION – ADR
In recent years, great strides have been made in Italy, in the area of alternative dispute resolution (ADR). The traditional methods of resolving controversies in the area of civil and corporate law do not always yield the most efficient or the most desirable results. Accordingly, ADR has become a welcome change in the Italian legal community. Since March 21, 2011, mediation has become mandatory in Italy in the following cases:
• real estate (including construction cases and cases involving distribution of property in an estate)
• division of property
• hereditary succession
• Landlord-tenant disputes
• eviction
• shareholder disputes
• medical liability,
• defamation
• insurance, banking, and financial contract disputes
One year later, on March 20, 2012, due to the high volume of disputes in other types of civil liability cases, mediation became mandatory in condominium disputes, and claims for damages arising out of vehicular or nautical accidents.
The Giannini Law Firm offers assistance and consultation in each phase of mediation, with the selection of the appropriate type of mediator from the registered list, preparation of the submission as well as client meetings, and participation in the actual mediation. Finally, as is required by Italian law, we prepare the Mediation Agreement.
